A court and/or The Dept. of Motor Vehicles (DMV) may order you to complete an evaluation if you areĀ arrested/convicted for any of the following crimes:
- Driving While Intoxicated (DWI)
- Driving While Ability Impaired (DWAI)
- Driving While Ability Impaired by Drugs (DWAI Drugs)
- Driving While Ability Impaired by a Combination Drugs/Alcohol
- Refusal of Chemical Test (DWI Common Law)
The evaluation must be done by an OASAS approved provider and must include the following to beĀ considered legitimate:
- A clinical interview based on DSM-V criteria for Substance Use Disorders (SUD)
- A urine toxicology test for substances analyzed by a laboratory and a breathalyzer
- Collection of Driving History Records (NYS and out of state)
- Collection of police documents including Bill of Particulars, Uniform Traffic Tickets, SupportingĀ Depositions and Toxicology Reports
- Collateral interviews with relevant individuals
