OASAS DWI/DWAI Evaluations

A court and/or The Dept. of Motor Vehicles (DMV) may order you to complete an evaluation if you areĀ arrested/convicted for any of the following crimes:

  • Driving While Intoxicated (DWI)
  • Driving While Ability Impaired (DWAI)
  • Driving While Ability Impaired by Drugs (DWAI Drugs)
  • Driving While Ability Impaired by a Combination Drugs/Alcohol
  • Refusal of Chemical Test (DWI Common Law)

The evaluation must be done by an OASAS approved provider and must include the following to beĀ considered legitimate:

  1. A clinical interview based on DSM-V criteria for Substance Use Disorders (SUD)
  2. A urine toxicology test for substances analyzed by a laboratory and a breathalyzer
  3. Collection of Driving History Records (NYS and out of state)
  4. Collection of police documents including Bill of Particulars, Uniform Traffic Tickets, SupportingĀ Depositions and Toxicology Reports
  5. Collateral interviews with relevant individuals
